RENTAL POLICY

Must be at least 18 years of age to rent.

Rental Period

Rentals returned early are not eligible for a rental refund, as we have blocked out the rental for the rental period. Return rentals on or before the due back time to avoid additional charges. The time rentals are due back is adjusted to align with our business hours. All rentals must be returned during business hours. DO NOT RETURN RENTALS OUTSIDE BUSINESS HOURS UNLESS ARRANGED IN ADVANCE AND CONFIRMED - If a rental is returned after business hours, the renter remains responsible for the rental until normal business hours which includes any rent due, damage, vandalism, theft, weather damage, etc as we will not be there to inspect and put the trailer away.  

Day Rental: 6 hours from time of pickup.

Overnight Rental: 24 hours to the same time as pickup.

Week Rental: 7 consecutive days to the same time as pickup.

Month Rental: 4 consecutive weeks to the same time as pickup.

Self-Pick Up Options

Customers who elect to self-up are required to provide photos and or videos taken at the time of pick-up and drop-off. Customer is responsible for any damage to rented equipment as well as providing insurance as required. Self-pick up customers who do not take clear, ample photos will be held liable for any damages noted on trailers or equipment upon its return.

ID and Insurance

Must be 18 years or older to rent. A valid driver’s license in the name of the renter is required for all rentals. Responsibility for rental items remains with the customer from pick up or delivery until return. It is the renter’s responsibility to ensure all items are secured and protected from weather, damage, and theft. Insurance coverage on rented equipment is the responsibility of the customer. Additional charges may be added for missing or damaged items.

Rental Contract

A signed Rental contract is required for all rentals in the name of the customer renting.

Reservations and Cancellations

Please call for availability on rentals. Reservations are encouraged on all rentals and require half the total cost of the rental with a $250.00 security deposit. The balance of the rental cost is due upon return, along with charges for any missing or damaged items. Reservations are non-refundable unless cancelled at least two weeks prior to the rental.

*Reservations MUST be cancelled at least 1 week prior to your rental date for a refund to be given.

Payment

Reservations require half the total cost of the rental with a $250.00 security deposit upon booking. Full payment of the balance due is required on all items upon return to the rental yard, along with charges assessed for any missing or damaged items. Security deposits are released upon 48 hours of return for items which are returned in full with all pieces.  A credit card must be in the name of the customer renting and will be kept on file to be automatically charged for balances due, late returns, and damage payments. We accept American Express, Discover, Master Card, and Visa.

Damage Deposit

Valid credit card required for the damage deposit. Damage deposit amounts may vary depending on items rented, length of rental term, and state on driver’s license. Customer is responsible for any damage to rented equipment as well as providing insurance as required.

Damaged Equipment and Balances Due

Balances due for damaged or overdue rentals, and/or refueling costs will be charged accordingly. All unpaid amounts will be considered a collection situation 3 days after the balance invoice has been received. After 3 days and the third notice has been provided, the legal collection process will be started including claims for reimbursement for all legal fees incurred. We try to avoid this process at all costs and appreciate your understanding of this matter.

Cleaning and Refueling Fee

Trailers and equipment are rented to the client in a clean and fully-fueled condition. Rentals must be returned clean and full of gas or fuel to avoid additional charges. It is the responsibility of the customer to ensure proper fuel is used for the rental. A cleaning fee will be charged if a rental is returned dirty at the rate of $150.00/hr.  A refueling fee of $9.50/gallon will be charged if a rental is returned insufficiently fueled.

Hour Metered Items

Rates for rentals equipped with hour meters are based on 8 hours per day, 40 hours per week. Additional usage will be charged accordingly.

Problems / Troubles

All rental charges are for time out whether used or not.  If you encounter any problems, call 385-227-9177 immediately.  No credits or adjustments will be made unless notified as soon as there is a problem. Damage to rental equipment caused by customer is not reimbursable. We do not allow other companies to work on our equipment since most are still under warranty. You are responsible for returning the rental item to our location for repairs or for payment of a pick-up fee to do so.

LEGAL TERMS

1.Lessee agrees that the Leased Equipment has been received in good condition and represents and warrants that it will be returned in the same condition, notwithstanding ordinary wear and tear. 

2. Lessee understands and acknowledges that the activity to be engaged in through Lessor’s lease of the Leased Equipment brings with it both known and unanticipated risks that could result in property damage, physical or emotional injury, paralysis, death or other damage or injury to Lessee, its guests, its invitees or third parties. Lessee understands that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. Those risks include, but are not limited to falling, slipping, crashing and colliding.

3. Lessee agrees to release, forever discharge and hold harmless Lessor for any injuries, damages or claims that result from Lessee’s negligence; including any injuries, claims or damages asserted by Lessee’s guests, invitees or third parties. Lessee agrees to release, forever discharge and hold harmless Lessor for any injuries, damages or claims that are the direct result of Lessor’s negligence; including injuries, claims or damages resulting from defective Leased Equipment or improper assembly or installation or maintenance of the Leased Equipment.

4.Lessee agrees to supervise both the Leased Equipment and its use at all times the Leased Equipment is in the possession of Lessee. Lessee agrees to follow the directions and safety rules as posted on the Leased Equipment or as otherwise provided to Lessee by Lessor.

5.Lessee acknowledges and represents that it has adequate homeowner's insurance, tenant insurance, or other liability insurance to cover any bodily injury or property damage which might occur to itself, its guests or its invitees from the use of the unit being rented or else lessee agrees to bear the costs of defense and liability of any such injury or damage itself.

6.Lessee agrees not to remove the Leased Equipment from the location on which Lessor has assembled or installed it. Lessee further agrees not to disassemble or uninstall the Leased Equipment or to assemble or install the Leased Equipment.

7.Lessee grants Lessor right to enter Lessee’s property for the delivery, pick-up or repossession of the Leased Equipment. Lessee agrees not to loan, sublet or otherwise dispose of the Leased Equipment.

8.In the event that Lessee files a cause of action against Lessor, Lessee agrees to do so solely in the state of Utah, and further agrees that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state.

9.Lessee agrees that if any portion of this Contract is found to be void or unenforceable, the remaining portion shall remain in full force and effect

10.Lessee acknowledges that sufficient time and opportunity were had to read this entire policy, and understands its content and is executing it freely, intelligently and without duress of any kind and agrees to be bound by its terms Renter understands and agrees calls may be recorded at any point and time .

11. Lessee understands he or she is liable for any damages caused during their rental and will be charged down time every day until the unit is back in rental state. Down time is the daily rental price of the unit per day.

RENTER DECLARATION OF KNOWLEDGE AND INTENT

1. I am least 18yrs old and hold a valid and active driver’s license.

2. I understand and intend to abide by all laws and regulations of the roads, trails, waterways, and bodies of water in which the rented equipment is used and/or transported. Renter also understands no drugs/alcohol to be used around on or in machines or under influence at any time while operating equipment! 

3. I fully understand how to operate and use the rented equipment

ENTRY/REPOSSESSION: RENTER shall allow OWNER to enter RENTER’s premises where the rented equipment is stored or used at all reasonable times to locate and inspect the state and condition of the rented equipment. If RENTER is in default of any of the terms and conditions of this agreement, OWNER, or his agents, at RENTER’s risk, cost and expense may at any time enter RENTER’s premises where the rented equipment is stored or used and recover the rented equipment. RENTER indemnifies and holds OWNER harmless for all injuries or damage of any kind for repossession and for all consequential and special damages for any claimed breach of warranty. LIENS/ENCUMBRANCES: The RENTER shall not pledge or encumber the rented equipment in any way. DEFAULT/REMEDIES: The OWNER may terminate this agreement immediately upon the failure of RENTER to make rental payments when due, or upon RENTER’s filling for protection from creditors in any court of competent jurisdiction. To enforce any breach or in any lawsuit involving statutory or contractual obligations of OWNER or RENTER, the non-defaulting party shall be entitled to recover costs of collection, attorney’s fees, court costs, and all other costs from the defaulting party, regardless of whether the matter is litigated or not. All amounts past due and/or in any lawsuit the entire judgment shall bear interest from due date at the rate of twenty four percent (24%) per annum compounded daily until paid. In the event obligations under this agreement or its addendums is assigned to a collection agency or attorney, a collection fee of forty percent (40%) of the debt/obligation assigned shall be added to the amount owed pursuant to the terms hereof and as allowed by law. WARRANTIES: OWNER makes no warranty of any kind regarding the rented equipment, except that OWNER shall replace the equipment with identical or similar equipment if the equipment fails to operate in accordance with the manufacturer’s specifications and operation instructions. Such replacement shall be made as soon as practicable after RENTER returns the non-conforming equipment. In the case that a comparable item to rent is not available, a refund will be issued. INDEMNIFICATION: RENTER shall defend, indemnify, and hold harmless OWNER, its officers, officials, and employees from and against any and all claims, suits, actions, or liabilities for injury or death of any person, or for loss or damage to property, which arises out of RENTER’s use of the rental equipment, or from any activity permitted, or suffered by RENTER by others, except only such injury or damage as shall have been occasioned by the sole negligence of OWNER. ACCEPTANCE: These terms are accepted by the RENTER upon delivery of the terms to the RENTER or the agent or other representative of RENTER.
